We are using MRF89XAM8A module for Europe, and the legislation requires us to emit less than 0.1% of the time.

    Since the duty cycle is measured over a one hour period, I don't think so and could not find anything about that in the module and chip manual.
 
You have to solve this at a higher level in your software. Make sure you don't send more often than 0.1% of the time. The following limitations apply:
Total on time within one hour: 3.6 seconds (0.1%)
Maximum on time for one transmission: 0.72 seconds
Minimum off time between two transmissions: 0.72 seconds.

On this page you can see the list of RF modules which are going through the new european RED certification.
The MRF89XAM8A module is in the list.
On the MRF89XAM8A page  http://www.microchip.com/wwwproducts/en/MRF89XAM8A  click on the documentation tab and you will see a list of application notes. I guess you can use the AN1340 (radio driver) to program your test conditions

At the end, the only way was to measure the emission time using a spectrum analyzer.
It appears that the emission of a 16 bytes packet takes around 9ms. In other words, it is allowed to send a 16 bytes packets every 9 sec.
